I coulda swore I made this Fuck You, California! post, but I apparently didn’t actually post it.  So here it is now: FUCK YOU, CALIFORNIA.

Still got some work to do, I see. Someday we’ll look back on this and wonder how we ever could have even argued about this shit. I myself don’t understand what the big deal is about marriage—I see it as a strategy for social regulation, and that people get so up-in-arms about how it should be shows that they really don’t understand the big picture. But that we allow some people this and not others for no good reason is terrible.

 

I would also like to apologize for my state, without whose support Prop 8 would have had a harder time passing.  You would think a state founded by people who wanted to try unconventional marriage, a state where many are still sympathetic to people who practice institutionalized incest and statutory rape, would have the grace to shut the hell up. Sorry. I will give Utah a stern talking-to.

 

We’ll make it. This is a setback, but we’ll make it, dammit.

Don't forget Arkansas, which passed laws against allowing non-married people from adopting. Conveniently, same-sex marriage is illegal there, so they don't have to worry about teh gheis teaching their children that it might be okay to be gay.

On the plus side, New York finally has a Democratic majority so this coming term there might be laws allowing same-sex marriage. Last time it was tried, the Republican-controlled State Senate killed the bill by not voting on it in time. We already recognize same-sex marriages performed elsewhere, which is good as three of our neighbors (two states and Canada) allow it.

On the bright side, the ACLU and various other groups already had writs set up for lawsuits against prop 8 in CA. It's being challenged /instantly/.

Plus it may not even have been a legal vote, because amendments to the state constitution like that have to be run through the state legislature... and guess what step was skipped for prop 8?

Amendments to the state constitution don't have to be run through the legislature. The California constitution is amended by popular initiative all of the time. It's full of stuff that really shouldn't be there but is in order to get around loopholes formed by other clauses in the constitution (frequently due to previous amendments that don't really belong in a constitution). Practically every ballot's batch of propositions contains a few amendments. For example, the constitution is full of clauses mandating certain sums of money to be set aside for specific purposes, so nearly any attempt to shift budget priorities around has to be an amendment.

There simply isn't a clean division between constitutional and statutory topics in California government.

The No on 8 group's argument is not that the constitution cannot be amended by initiative, but that Prop 8 contradicts more fundamental principles of the California charter to such a degree that it is not a mere amendment, but rather a revision of the constitution, which would require a 2/3 vote of the legislature. Unfortunately, this argument almost never works. Including when they tried to use it to block Prop 8 from getting on the ballot.

So, don't hold your breath.

On behalf of CA, I apologize. And plan to continue fighting this thing. At least I can still be proud of my home state of MA. My own mom (the total square) voted to decriminalize possession of small amounts of weed!
